Tomorrow at 5:30 p.m. the CMPA’s EBO Committee will hear a report from the EBO Compliance Officer Lou Ray on a complaint by GB Green Construction regarding subcontract Heaton Brothers Construction. When Heaton bid on the park sitework, he included Heaton as a minority sub for approximately 30 percent of the $5M bid. During the value-engineering process, Heaton did not give Green notice that his company would not be used and sought no approval to replace Green on his EBO Form 6. Heaton didn’t notify the general contractor, Magi Construction, until Nov. 15 that a new minority subcontractor would be used. Green never approved of the change.
According to Ray: “Both the letter and spirit of the Maritime Park Equal Business Opportunity commitment are violated but these actions.”
