City Attorney memo: City Council has some control over BP boom ops

Pensacola City Attorney Rusty Wells has sent the City Council a memo, “Pensacola-Based Deepwater Horizon Oil Spill Cleanup Measures,” that while the City can’t stop BP from setting up its boom cleaning operations in Bayou Chico, it can require a surety or cash bond from BP to cover any cleanup costs if the operations recover remediation “resulting from any spillage or mishandling of the polluted and ultrahazardous material during transport and cleanup activities taking place within the City limits.”

City can require BP to establish a fund that will pay for an independent contractor to monitor the operations and report to the City.
