County Considers Settling Lawsuits

During the board’s meeting tomorrow, the Escambia County Commission may be settling two lawsuits filed against the county.

The first lawsuit involves a traffic accident on Cervantes Street. Roy M Stallworth filed suit against Escamia County Medical Services for personal injuries. Stallworth’s attorney initially requested $40,000 to settle. The county is considering offering $17,500.

The other lawsuit was brought by Jacenta Walker, who claims that the county damaged her townhouse when it demolished an adjoining unit. The unit was demolished after sustaining fire damage and receiving numerous code-enforcement violations.

Walker was apparently never notified of the demolition, which ended up exposing portions of her own unit to the outside environment. She filed suit, requesting what the county is referring to as her “significantly-reduced settlement demand” — $47,500.

County commissioners will be considering putting up $37,500. of the sum, with the remainder split between the demolition contractor and subcontractor. Under that arrangement, Swalley Construction Co. and BP Excavating would each pay $5,000. to Walker.

The Jan. 5 Escambia County Commission meeting begins at 5:30 p.m. at the downtown county complex.
