ECUA was formed by a special act of the Florida Legislature. It got the rights to the county’s sanitation through a transfer agreement with the Escambia County Commission. I asked County Attorney Alison Rogers whether these agreements gave ECUA the right to build transfer stations.
It’s her opinion that ECUA must have the permission of the BOCC to do so. If ECUA tries to build one downtown, they could be in for a legal battle.
