Hayward vetoes Council action on airport concession

s afternoon, Mayor Hayward vetoed Council Resolution 07-14, which purported to extend the current food and beverage lease and concessions agreement at Pensacola International Airport. As both the City Attorney and an opinion provided by outside legal counsel have advised, the City Council does not have the authority to take this action.

“While I believe Council took an improper action, I have exercised my executive veto power out of an abundance of caution. My City administration went above and beyond to conduct an extremely fair competitive bidding process that remains uncontested by any of the RFP participants. I am disheartened that some City Council members continue to try to undermine and circumvent the fair process, and continue to act in a way that subjects the City to legal liability.

I plan on awarding the concessions contract to OHM.

OHM Group’s minimum annual guarantee translates into an additional $1,038,720 over and above the current vendor during the 10 year contract, OHM brings over 100 jobs to the local economy, OHM ensures 60% of goods and services purchased will be made with local vendors, and OHM is 100% Florida Certified Airport Concession Disadvantaged Business Enterprises operations. This is clearly the best business decision for the airport and the traveling public.”

There will be no interruption in service, and no further action by Council is necessary to ensure service.
