The indictment of Justin J. Wright states he “engaged in conduct that placed the person in reasonable fear of death of and serious bodily injury to that person, an immediate family member of that person, and a spouse and intimate partner of that person” in violation of Title 18 US code sections 2261A(1)(A) and 2261(b).
An attorney has pointed out that the code regarding stalking says “or,” not “and.”
- 18 U.S.C. § 2261A(1)(A)(iii) defines a category of conduct that falls under federal stalking law: it applies to a person who travels across state lines or into federal jurisdiction with the intent to harm, harass, intimidate, or place another person under surveillance, and in doing so, engages in behavior that places that person’s spouse or intimate partner in reasonable fear of death or serious bodily injury.
Is this a typo in the indictment?
