Judge denies Childers Writ of Mandamus

Circuit Judge Jenifer J. Frydrychowicz denied Bruce Childers’ petition for Emergency Writ of Mandamus without prejudice. Childers filed the petition to get on the August primary ballot to run against Supervisor of Elections Robert Bender.

Childers did not cite a rule or statute by which he asserts the court has jurisdiction. He also failed to provide the various documents he mentioned in the petition.

She wrote, “When a petitioner files a petition for mandamus, the court has the initial task of assessing the legal sufficiency of the allegations. If the court finds the allegations insufficient, it will deny the petition or dismiss those claims that are factually insufficient.”

Thus, the petition was denied. Read Order 2.
