Circuit Judge Jenifer J. Frydrychowicz denied Bruce Childers’ petition for Emergency Writ of Mandamus without prejudice. Childers filed the petition to get on the August primary ballot to run against Supervisor of Elections Robert Bender.
Childers did not cite a rule or statute by which he asserts the court has jurisdiction. He also failed to provide the various documents he mentioned in the petition.
She wrote, “When a petitioner files a petition for mandamus, the court has the initial task of assessing the legal sufficiency of the allegations. If the court finds the allegations insufficient, it will deny the petition or dismiss those claims that are factually insufficient.”
Thus, the petition was denied. Read Order 2.
Next up is the Emergency Motion that he filed on Monday.

CJ, Bender assigned the secondary review to another staff member to avoid any conflict. This is the customary accross the state when supervisor has an opponent.
We only have one side of the story and it has several holes.
I stand corrected. Nothing says you’re unqualified to supervise elections more than filing a petition for mandamus filed to excuse you from your failure to attach all necessary docs to your qualifying paperwork and get denied because you didn’t attach all necessary docs to your petition for mandamus.
Setting a precedence to using contrived reason to force an unqualified candidate on the ballot would be wrong.
Note the hypocrisy of the woman holding the sign at the protect that she must think is a clever pun about rule Bender when in fact they are asking the rules to be bent themselves to allow an unqualified candidate to run.
Hopefully more people realize what a a twisted mentality those folks have.

Regardless of how this plays out, it did bring to light an issue internal to the SOE operations. Childers didn’t raise it. The “Qualifying Check List” used for candidates required to submit a Form 6 to the SOE (new candidates) or a “receipt” (incumbents) contains no place for the SOE staff to certify receipt of the full Form 6. That might be the source of confusion if Sonya Daniel and “KS” were advising candidates or reviewing documents and using the check list as a guide. What is the origin of the check list? Who put it together and when? If the check list had contained a third box to document receipt of a full Form 6 from a new candidate that would have clearly alerted SOE staff to tell Childers right up front on June 12th that he was not yet qualified. It would be very interesting to find out what was going on inside the SOE office between June 12th and June 18th. If an “extra special” review of only Bruce Childers’ qualifying file was done, who directed it and when? Did Robert Bender personally review his opponents file looking for defects? I do recall hearing him say on the radio that he did not conduct a “secondary review.” Did he conduct his own review? Who had access to the file online or in hard copy? Was a copy given to anyone outside of the SOE to review? I’d hate to think that the SOE Office discovered the issue on June 12th, June 13th or June 14th and then sat on it until June 18th when it was too late. That is how it does appear for now.
Because Pam, the Clerk of Court, and Bruce, a lawyer, continue to be an organizational and logistical disaster, and can’t even check the minimum boxes on necessary process.
And yet somehow they think Bruce is a good fit for Supervisor of Elections.
No wonder they had to go get Ed Fleming. Is their plan be put Ed on retainer to count votes for them, too?
