Myers vs. Hayward Round 2, back in court

Councilwoman Sherri Myers has filed a Motion for Clarification or Rehearing. She is asking Judge Scott Duncan to delineate the proper scope of the Mayor’s communication policy authority, “such that employees of the City of Pensacola, as well as Council Members, may be aware as to what the proper limits of a Council Member’s request for information to entail.”

Her attorney goes on to ask in the filing: “Does the example of a constituent contacting their Council Member, and their Council Member relaying this information directly to a city employee, or requesting information based on that constituent request, constitute an action undertaken under the authority of City Council?”

Mayor Hayward has interpreted Duncan’s court order as meaning that the authority to conduct inquiries and investigate is vested in the city council, not individual council members. He has said the council members are to make their individual inquiries and requests directly to him and his office, not to city staff.

Myers disagrees.
