Nodine prosecutor vindicated


The Mobile Press Register is reporting that Baldwin County Circuit Judge Charles Partin dismiss charges by former Mobile Commissioner Stephen Nodine that then-Baldwin County District Attorney Judy Newcomb withheld key evidence from the defense in his murder trial.

“Based upon the foregoing findings, the Court is of the opinion that the prosecution in this case has not been guilty of any misconduct that would warrant a dismissal of the indictment,” Circuit Judge Charles Partin wrote.

In December 2010, a Baldwin County jury failed to reach a unanimous verdict on charges that Nodine stalked and murdered his longtime girlfriend, Angel Downs, outside of her Gulf Shores home.

In September, a Houston County jury — selected because of excessive publicity in the Mobile-Baldwin area — will hear charges against the former commissioner.
