Simplified Founder & CEO Emily Ley has filed the first complaint against the Trump Administration over the new tariffs on China. Ley appeared on MSNBC with her attorney to discuss how the tariffs have impacted her business and customers.
The Impact on Small Business
Ley founded her business in 2008, creating beautiful planners and paper goods now carried in major retail stores and on her website. Since 2017, her company has paid nearly $1.2 million in tariffs. As she explained during the interview, these financial burdens affect every aspect of her business, from salaries to growth opportunities and even their philanthropic efforts.
Ley is particularly concerned about the human cost. Her company employs nine American women, many of them mothers.
“These tariffs are impacting people on a very human level,” Ley shared. “We have women who worry about their jobs. We have customers concerned they’re not going to be able to get the products they’ve known and loved for sixteen years.”
According to Ley, what began as “scary” in 2017 has progressed to feeling “impossible” and now “absolutely devastating. ”
The Legal Challenge
John Vecchione, senior litigation counsel at the New Civil Liberties Alliance, represents Ley in this civil case. Vecchione outlined three principal arguments against the tariffs:
- The statute being used (AIEPA) doesn’t actually allow for tariffs, but rather measures like embargoes
- Under the “major questions doctrine,” if an action significantly affects the economy, Congress must clearly authorize such power.
- Tariffs are constitutionally a congressional power, and if delegated to the president, Congress must provide clear guidelines for implementation.
MOVING FORWARD
While acknowledging the risk of taking such a public stand, Ley hopes her actions will inspire other business owners to speak out about how tariffs affect them “at a very deeply personal level.”
She noted that the impact extends beyond companies importing finished products from overseas—even American-made businesses sourcing raw materials internationally will feel the effects.
For Ley, this fight represents more than just her company’s bottom line.
“As an entrepreneur, as a creative, it devastates me,” she explained. “It feels catastrophic to have to look at the future of my American dream—of the American dreams of so many people—and feel like this is where it ends.”
I think the people making these comments in tariffs need to do a little more research on how it is hurting our economy. I also love the comment “ make it in America” but do you realize that would do exactly what you are complaining about raise the price of everything. Why do we always have to compare apples or oranges. Of course there are things Biden did that were not correct. But can’t we go back to the simple kindergarten saying “two wrongs don’t make a right” Could people please stop being so party loyal that we can’t hold our public officials accountable when they do something wrong regardless of party? We as American citizens should be better than this.
Is she producing light bulbs?
Mrs Ley I’m from Pensacola and I’m 100% behind you. These ignorant comments made should be ignored. This is an asinine thing to be doing. It’s clear what’s happening. This is being done to destroy the world wide economy. He did this last term and it was a catastrophe. He knows what’s going to happen. It will cause millions to lose everything and Oligarchs will buy up farms and entire neighborhoods for nothing. He’s stomping on the Constitution and rule of law. He’s deregulating which is terrible for We the People and allows the banks, mortgage lenders and many more to take advantage of us during an engineered depression. He’s trying to dismantle the institutions that protect us like CFPB n FTC etc.. that protect us from predatory practices and grifters. While idiots cheer the “Deep State” being dismantled. Biden did targeted tariffs in specific countries. Not blanketed globally. Biden didn’t hit our neighbors like a complete idiot! The govt collects them and we get the largest tax hike in history while tariffs collected will go towards a $4.2 trillion tax cut you have to make $350k a yr to use it. And billions in corporate welfare. If you know 5th grade math and aren’t brainwashed it’s blatantly apparent. Things will not get better by design. Economic ruin an potentially even a war. Will have idiots in the streets accusing whoever he blames of causing it. He’ll claim to be the only one that can fix it and try to leverage economic disaster he’s engineered to stay in power. It’s history repeating and it’s blatantly obvious. Something has to be done to stop it. How so many can be so utterly clueless at this point unforgivable. Thank you and hopefully it’s a trend that spreads like wildfire. This same idiocy was a disaster last time he tried this and that was only on a few things from China. He’s an terrible businessman and always has been clueless. He’s a very good scammer however. To think he’s doing anything different than he has entire life is just moronic. Given the comments being allowed I’m sure this won’t be..
It’s funny how so many protest and sue because of the tariffs, but no one sued Biden for raising the prices in everything so high that many couldn’t afford the simplest things, and no one sued for bringing millions of illegals and wasting our tax moneys on them. Giving them so much free while vets were pushed out of homes and had to suffer. This will get better, and patience is the key. At least we will see lighter times coming. People actually need to understand what tariffs do. This country has been taken advantage of for so long, that it is time that it will stop. For so many it is easy to blame Trump for everything because of their hate for him. It’s pitiful.
Find US sources for the products you need, it’s not difficult.
Flash back than she should have sued Biden too! And why dint she do that?? Joe Biden announces tariffs in 2024…
“Today, I’m announcing new tariffs.. that’ll ensure that our workers are not held back.”
Where was the media outrage?
Where was the leftwing outrage?
Where was the RINO outrage?
I guess tariffs are only okay when Democrats impose them.
HER
It’s a shame Mrs Ley chose to put herself over the country and its citizens as a whole. We have been taken advantage of for far too long and our politicians have profited off their dirty dealings for far too long. Realistically if Mrs Ley’s business was in debt as far as we the tax payer and the business of running our country her business would have gone bankrupt.
Business is business. Find a way around the tariffs. Quit complaining. Your case is a loser. Everybody has it rough right now. Thinking your business is special? It’s not. If you were producing something vital to humanity, then maybe. But day planners and diary’s aren’t very important right now. Try making more large protest signs. See if that helps.
Everybody, except for a few, are being held back by tariffs.
It is past time for a leader to address this. It will be painful to fix a longstanding mess.
