Underhill’s ‘plea bargain’ to avoid removal from office in ethics case

Yesterday, I broke the news that Commissioner Doug Underhill’s attorney Mark Herron recommended that the commissioner should “be subject to a public censure and reprimand” for state ethics violations.

On “Real News with Rick Outzen” this morning, I discussed with attorney Troy Rafferty whether this recommendation by Herron was a plea bargain.

“That’s what it is. It’s a plea bargain,” said Rafferty. “Don’t kick him out of office, just publicly censure him.”

Rafferty added, “And if your lawyer’s doing that…first of all, the lawyer doesn’t have the authority to do that without the permission of the client, okay? You’re exactly right. Rick, this is a plea bargain.”
