Varona hearing on temporary injunction today, 2 p.m.

Varona Enterprises of Florida will have its day in court today, that is unless the city can reach an agreement. As of last night, the hearing was set for 2 p.m.

Varona has asked Judge Gary Bergosh for a temporary injunction enjoining the City of Pensacola from removing the company’s equipment from the Pensacola International Airport in breach of its agreement which gives the food concessions vendor 60 days to vacate the airport. The 60-page filing details what has transpired over the past six days.

On Friday, March 27 attorney John Trawick sent a letter to Varona Enterprises giving it until midnight of April 1 to all its equipment and property out of the airport. If the company failed to do so, the city would remove it, store it and charge the company for storage and removal expenses. City Communications Director Tamara Fountain has denied any knowledge of the letter and said no one at the city reviewed or approved it.

The hearing has been delayed twice and Mayor Ashton Hayward and City Administrator Colleen Castille have been served subpoenas.
