Jonathan Green refiled his request for a temporary restraining order on the demolition of the Malcolm Yonge Gym on East Jackson to give those wanting to force a citywide referendum on the demolition time to gather 4,100-plus petition signatures.
Green argues:
“Should the city demolish the Malcolm Yonge Gym before the time allowed for the Plaintiff to engage in the lawful collaborative effort of the other committee members to collect signatures, Petitioner’s rights under the City Charter, State of Florida Constitution, and U.S. Constitution will be violated. The City Charter provides citizens with a process to address their grievances to the government but also to initiate a citizen’s referendum.”

The key legal point is that City Clerk Burnett issued the petition on February 16th but “five days later” on February 21st Mayor Reeves sent out a demolition notice. Up to that point, Mayor Reeves had implied that he was going to ignore the Charter’s referendum process. But Mayor Reeves’ issuance of the demolition notice demonstrates his real intent to do so.
